Terms & Conditions
These are the terms and conditions on which you order with us online, by phone or by email. Your use of this website signifies your acceptance of these terms and conditions. We reserve the right to amend these terms and conditions at any time and by continuing to use this website you are deemed to have accepted those amendments.
Ordering Goods from Us
Our prices are in New Zealand Dollars. When you place an order with us you are making an offer to purchase goods. You place an order on our website by adding a product to the shopping cart and proceeding through the Checkout process. The Checkout process includes giving us delivery and other relevant details for your order and payment. You must complete all mandatory fields when ordering products.
All orders are subject to availability. We reserve the right to limit the quantities of a particular item that you may order. We also reserve the right to limit the number of items that you can purchase in a single transaction. There is a cut-off time for orders. Any order requests after this time are entirely at our discretion.
Once we have accepted your order you will be taken to a confirmation page with all details of your order. You will be able to print the confirmation page as proof of your purchase. You will also receive an email from us confirming that we have received your order.
Variation or Cancellation of Order
Once we have accepted your order you cannot vary or cancel your order, save in exceptional circumstances which are entirely at our discretion. In order for us to consider a variation or cancellation of an order you must provide us notice of such variation or cancellation prior to the due date for dispatch of your goods.
Delivery and Delivery Charges
We deliver to Tauranga addresses only, from the CBD to Greerton, Mount Maunganui to Hewlett’s Road, Otumoetai and Pillans Point. Any delivery outside these areas are at our discretion and may incur delivery fees or be subject to minimum order requirements. We do not deliver to post office boxes. Products will be delivered to the workspace designated on your order.
If we cannot drop off your lunch and cannot get through to you via your contact information, we will continue on our route and you won’t receive your lunch but payment will be taken.
All goods are packed in bamboo lunchboxes and are kept in an ice packed chilly bin during delivery. The goods become your property and your responsibility once they have been delivered to the delivery address stated in your order. We recommend that you arrange for the goods to be delivered to an address where you are likely to be available to personally receive them. Any goods that are not consumed right away upon receipt should be kept in a fridge. It is your responsibility to do so.
By placing your order, you authorise us to leave the goods at the delivery address stated in your order regardless of whether someone is available to personally receive them or not. We do not accept any liability for the quality or freshness of your goods where you are not available to personally accept them. Goods will not be left outside or in a mailbox unless we have made a prior agreement. In some cases, we can agree to leave your lunch in an ice packed chilly bin you have left outside your workplace if you will be out during delivery. In this case, the quality and safety of the lunch is entirely your responsibility once it is left at the prearranged location.
We always endeavour to provide you with the freshest and best quality products available. However as our products are perishable they cannot be returned and no refunds or exchanges will be available. The only exceptions to this are if we have made a mistake in processing your order or delivering your order to you or where you are able to show that your goods were delivered and received personally by you in a spoiled condition.
If you consider that we have made a mistake in processing your order or in delivering the products to you or in the quality of personally received goods, please email us at email@example.com immediately. In any of these situations we will consider your request for a refund or exchange of goods but any such refund or exchange of goods will be entirely at our discretion. We reserve the right to offer partial refunds where one of the above situations applies to part of an order only.
We have made every effort to portray the products available on the website as accurately as possible. However, from time to time there will be some variation between the photos and the actual products. We accept no liability in respect of any variations.
All Heart and Stove products are made in a ktichen with no dietary restrictions which may contain traces of all allergens.
